HR - Parental Leave Package
Paid parental leave can include both employer-funded and government-funded schemes. The Australian Government's Paid Parental Leave Scheme under the Fair Work Act 2009 requires all employers to provide Parental Leave Pay to all eligible employees. Under the National Employment Standards (NES) and the Fair Work Act 2009, employees can take up to 1 year of unpaid parental leave if they have worked continuously for their employer for 1 year or longer. Employees on parental leave have a legal right to return to their job (or a job of equivalent pay and status) once they return from leave. The Parental Leave Policy explains an employee’s parental leave entitlements and responsibilities and the procedure the employer must follow when an employee wants Parental Leave, as well as a signed Employee Acknowledgement of the policy. The package (7 documents) includes Parental Leave and Change of Dates forms, letters to advise of acceptance and refusal (including for leave extensions), as well as a checklist for employers to make sure all obligations are met under the Scheme.
